Terms of Service

These Terms of Service ("Terms") govern your use of BirchSeek, provided by Internet Technology Services LLC ("we", "us", "our"). By using our services, you agree to these Terms.

1. Service Description

BirchSeek generates search-targeted articles and can publish them to a destination you connect. The service is available on a paid subscription only.

2. Account Terms

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the security of your account.
  • You are responsible for all activity that occurs under your account.
  • Your account is for your own use. You may not share, sell, or transfer it.
  • You must be at least 16 years old to use our services.

3. Your Content and Output

You retain ownership of the material you provide and of the articles produced for you. You are solely responsible for reviewing output before it is published and for anything you publish. Generated text and citations may be inaccurate or incomplete, and we make no representation that output is accurate, original, or fit for any purpose.

4. Acceptable Use

You agree not to use BirchSeek to:

  • Violate any applicable laws or regulations
  • Infringe the intellectual property or other rights of any party
  • Produce or distribute unlawful, deceptive, or harmful material
  • Interfere with or disrupt our services or infrastructure

We may suspend or terminate accounts that violate these Terms.

5. Payment Terms

  • The subscription is billed in advance each month and renews until it is ended.
  • All prices are in US Dollars (USD) unless otherwise stated.
  • You authorize us to charge your payment method for the applicable fees.
  • Prices may change with 30 days' notice. Existing subscriptions are honored at the current rate until renewal.
  • If payment fails or the subscription ends, paid features stop.

6. Refund Policy

All payments are final and non-refundable.

This applies to every billing period, except where a refund is required by applicable law. For billing questions, contact contact@birchseek.com.

7. Limitation of Liability

To the maximum extent permitted by law, Internet Technology Services LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

  • Your use or inability to use the services
  • Any content generated by or published through the services
  • Any unauthorized access to or use of our servers or your information
  • Any interruption or cessation of the services
  • Any third-party actions related to your use of the services

Our total liability for any claims arising from your use of the services shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Disclaimer of Warranties

The services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or that they will produce any particular search, traffic, or ranking result.

9. Termination and Data

  • Ending a subscription takes effect at the end of the current billing period.
  • You may export your articles while your account is active.
  • We may suspend or terminate accounts for violation of these Terms.

10. Account Deletion

  • Users without an active subscription can delete their account at any time.
  • Upon deletion, account data is removed from production systems.
  • Users with an active subscription must end it first; deletion takes effect at the end of the billing period.

11. Changes to Terms

We may modify these Terms at any time. We will provide notice of material changes at least 30 days before they take effect. Continued use of the services after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of our services shall be resolved through good-faith negotiation first, and if unresolved, through binding arbitration.
